Terms & Conditions
Introduction
These Terms and Conditions ("Terms") govern your use of PassbookApp, a service provided by Proficonlabs Pvt. Ltd., which offers a white-label solution for jewellers to run their jewellery advance purchase plans online. By using PassbookApp, you agree to comply with these Terms.
Accepting the Terms
- By accessing or using PassbookApp, you agree to these Terms.
- If you do not agree with these Terms, you may not use PassbookApp.
Provision of the Service
- PassbookApp is a software as a service (SaaS) tool that helps jewellers automate their Savings SIP.
- Jewellers can subscribe to PassbookApp to run their jewellery advance purchase plans online.
- PassbookApp reserves the right to modify or discontinue the service at any time without prior notice.
Use of the Service
- Jewellers will receive a QR code for customers to access the jeweller's subscription web app.
- Customers can enroll in jewellery advance purchase plans, check PassbookApp, make payments, set up UPI autopay, raise redeem requests, verify KYC, and add nominee details through the web app.
- Payments made by customers will be processed by Proficonlabs Pvt. Ltd. on behalf of the jeweller and settled to the jewellers(T+2 Days).
- Customers cannot withdraw cash through the service.
- PassbookApp is not responsible for any payments made by customers to jewellers.
- Messages sent to customers will be sent via PassbookApp with the jeweller's name included in the templates.
- Jewellers will receive a monthly billing statement for SMS and WhatsApp usage.
- All payment-related charges, including transaction fees, UPI mandate creation, and split payment charges, will be borne by the jewellers.
- PassbookApp does not charge customers any fees.
- Jewellers will have access to a dashboard to track enrollments, redemptions, redemption requests, and payments.
- No payment gateway is integrated into the jeweller's dashboard.
- Payments collected at the store must be updated by the jeweller in the provided dashboard.
- No cancellation or refund will be provided via PassbookApp.
- KYC verification will be conducted by Proficonlabs Pvt. Ltd. on behalf of the jeweller.
Account Security
- You are responsible for maintaining the confidentiality of your passwords and account information.
- You must comply with all applicable laws and standards, including PCI-DSS and PA-DSS, in connection with your collection, security, and dissemination of data.
- You must not store CVV2 data at any time.
Intellectual Property Rights
- PassbookApp owns all legal rights, title, and interest in and to the service, including any intellectual property rights.
- You are granted a non-exclusive license to use the software provided as part of the service.
- You may not copy, modify, create derivative works, reverse engineer, decompile, or otherwise attempt to extract the source code of the software.
Limitation of Liability
- PassbookApp is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses.
- PassbookApp is not responsible for any loss or damage resulting from changes to the service, discontinuation of the service, or issues related to data storage.
Changes to the Terms
- PassbookApp may update these Terms from time to time. You will be notified of any changes via email or through the website.
- Continued use of the service after any changes to the Terms will constitute your acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of India, specifically the laws of the State of Maharashtra. Any disputes will be resolved through arbitration in accordance with the laws of India.
